Moving to America

SC: Some people say it is easier to come in illegally and then stay.
RA: I don't think so. There have been some major moves in the U.S. system to limit the immigration of illegal entries. There are a number of provisions that say if you come in illegally you basically closethe door on future immigration. An illegal entry is something that is very difficult to overcome.

SC: What about students overstaying their visas?
RA: If they overstay, they could be subject to arrest and deportation. But a student going into a job offer has a little bit of a unique situation. If they do overstay, they can take certain steps to correct it and reestablish immigration status. However, the law is much more unyielding if someone comes for work and overstays his or her visa.

SC: Is there any advice you would give people who are interested in getting into the United States?
RA: Individuals interested in coming to the U.S. should get a good immigration attorney. They need someone who can analyze their situation and intentions and come up with a long-term strategy. Immigrating to the United States is not something that most people can do alone.
